Terms of Service

These Terms of Service ("ToS") govern the use of the Alpgain application — a personal asset tracking and financial-waste detection tool — accessible via app.alpgain.ch and the associated iOS / Android mobile apps. By creating an account or using the service, the user accepts these ToS without reservation. The structure of this document follows the recommendations issued by the State Secretariat for Economic Affairs (SECO) and the KMU portal for e-commerce GTC, compliant with the Swiss Code of Obligations (CO).
1. Object and scope
These ToS, together with the Privacy Policy and the AI Disclaimer, form the entire agreement between Alpgain and the user (hereafter the "contract"). They apply to any use of the Alpgain application — web version (app.alpgain.ch, staging.alpgain.ch) and native mobile version (iOS, Android). Any conflicting terms from the user do not apply, except with Alpgain's prior written agreement.
2. Service description
Alpgain is a software tool for visualising and aggregating personal wealth. It allows the user to centralise bank accounts, investment positions, pension assets (2nd and 3rd pillars), real estate and cryptocurrencies, and to view summary indicators (net worth, allocation, cashflow, tax projections).
- The service is non-custodial: Alpgain neither holds nor controls user assets.
- The service does not execute any market order, transfer or payment operation.

3. No financial advice — Non-provider clause under FinSA
Before any financial decision, the user is invited to consult a FINMA-licensed investment adviser, a tax adviser or a qualified lawyer.
Alpgain does not provide legal advice or tax advice either. Tax estimates displayed in the application are indicative projections based on simplified scales and cannot replace a tax declaration validated by a tax adviser or by the cantonal administration.
4. Formation of the contract
The contract is concluded between Alpgain and the user upon creation of an account on app.alpgain.ch or via the mobile apps. Account creation requires express acceptance of these ToS and of the Privacy Policy (checkbox at sign-up).
To subscribe to a paid plan, the user enters payment details via Stripe Checkout (hosted by Stripe Payments Europe Limited). The paid subscription contract takes effect upon payment confirmation by Stripe. The contract is not materialised on a physical medium; these ToS are accessible at any time from the application footer and a copy can be exported from Settings → Privacy.
5. Pricing plans and billing
Alpgain offers a free plan ("Free") and one or more paid plans ("Premium") whose terms and price are detailed on the subscription page. Subscription, billing and payment-method management are operated by Stripe (Stripe Payments Europe Limited) acting as payment processor. No card data ever transits Alpgain servers.
- The subscription is tacitly renewed at the end of each period, unless cancelled by the user from Settings → Subscription, with reasonable notice before the renewal date.
- No pro-rata refund is guaranteed by default; one may nevertheless be granted at Alpgain's discretion in exceptional circumstances.
- Prices are stated VAT-included in CHF (Swiss VAT applicable per the user status).
- Any price change applicable to ongoing subscriptions will be notified at least 30 days before it takes effect; the user may then cancel without penalty before the effective date.
- In case of payment default (declined card, failed direct debit), Alpgain reserves the right to suspend access to paid features after a grace period and an email notification.
6. User obligations
- The user warrants the accuracy of data provided at sign-up and keeps it up to date.
- The user is solely responsible for the confidentiality of their password and is encouraged to enable two-factor authentication (TOTP) available in Settings → Security.
- The user shall refrain from any use contrary to law, public order or morality, and in particular any attempt at unauthorised access, mass data extraction, interference with the service operation, or circumvention of security mechanisms.
- The user is solely responsible for the accuracy of the financial data they enter in Alpgain. Inaccurate input will produce inaccurate indicators.
- Any use by a minor under 16 requires the legal representative's consent.
7. Alpgain obligations
Alpgain undertakes to apply the reasonable diligence of a professional to deliver the service described in these ToS. This is a best-effort obligation, not a result obligation.
- Alpgain undertakes to deliver the service as described in the public documentation at the time of subscription.
- Alpgain enters into no contractual service-level commitment (SLA) in V1; no availability or latency guarantee is offered, except by separate explicit written agreement.
- Alpgain undertakes to implement the technical and organisational measures described in the Privacy Policy (AES-GCM at rest, TLS 1.3 in transit, RLS, periodic internal audits).
- Alpgain undertakes to notify the user of any data breach posing a high risk within the legal deadlines (revFADP art. 24; GDPR art. 33-34).
8. Intellectual property
All source code, algorithms, interfaces, trademarks, logos and editorial content of Alpgain remain the exclusive property of Alpgain or its rights holders. Any reproduction, representation, modification or distribution without prior written authorisation is prohibited.
Financial data entered by the user belongs to the user. Alpgain acquires no proprietary right over this data: it merely stores, processes and returns it as part of the service.
Alpgain grants the user, for the duration of their subscription and within the limits of the subscribed plan, a personal, non-exclusive, non-transferable and non-assignable licence to use the service for strictly personal and non-commercial purposes.
9. Limitation of liability
Alpgain is provided "as is" and "as available". To the fullest extent permitted by applicable law, Alpgain shall not be liable for:
- The inaccuracy, latency, suspension or interruption of third-party market data (Yahoo Finance, CoinGecko, ExchangeRate-API) — Alpgain does not control these sources and warrants neither their availability nor their accuracy.
- Outputs produced by the AI engine (Infomaniak AI, Gemma 4 model) — language models are inherently probabilistic and can produce inaccurate, incomplete or misleading information. The user acknowledges this probabilistic nature and undertakes to verify any critical information before acting.
- Service unavailability due to maintenance, technical incidents at sub-processors (Supabase, Infomaniak), force majeure or cyberattacks. No service-level guarantee (SLA) is offered, except by separate explicit written agreement.
- Financial losses, lost profits, missed opportunities or indirect damages resulting from decisions made by the user based on information displayed in Alpgain.
- Input errors made by the user themselves in the service.
In accordance with art. 100 para. 1 CO, Alpgain's liability for slight negligence is excluded to the fullest extent permitted by law. Liability for gross negligence or wilful misconduct remains governed by mandatory provisions of Swiss law and may not be excluded or limited. In any event, and to the fullest extent permitted by applicable law, Alpgain's total liability for the performance of the service is capped at the amount actually paid by the user during the twelve (12) months preceding the damaging event.
10. Third-party market data
Financial-instrument prices, exchange rates and asset fundamentals displayed in Alpgain come from third-party sources (Yahoo Finance, CoinGecko, ExchangeRate-API). These sources are provided for indicative purposes only. Alpgain warrants neither their accuracy nor their completeness nor their real-time availability. The user is invited to confirm any critical information with the primary source (broker, bank, exchange) before acting.
11. Artificial intelligence
Alpgain integrates an AI engine (Infomaniak AI, model google/gemma-4-31B-it, hosted in Switzerland) to generate chat replies, advice cards and transaction classifications. The outputs of this engine are inherently probabilistic and may contain errors or stale information. The detailed AI Disclaimer is accessible from the application footer.
The AI engine can be disabled at any time from Settings → Preferences → AI. No raw amount is sent to the AI provider — only anonymised qualitative signals.

13. Force majeure
Neither party may be held liable for non-performance or delayed performance of its obligations in case of force majeure, i.e. any external, unforeseeable and irresistible event within the meaning of Swiss law, including in particular: natural disasters, fires, wars, insurrections, governmental restrictions, massive outages of Internet or cloud infrastructure, major cyberattacks beyond reasonably foreseeable attack levels, major failures of an essential sub-processor (Supabase, Infomaniak, Stripe).
14. Termination and account deletion
The user can cancel their subscription and delete their account at any time from Settings → Privacy → Delete my account. Deletion triggers the "delete-account" Edge Function which purges all associated data (account, transactions, positions, snapshots, integrations) per the retention policy defined in the Privacy Policy.
Alpgain reserves the right to suspend or terminate any account in case of manifest breach of these ToS, fraud, abuse, or use contrary to law. A reasonable prior notification will be sent by email except in case of a security emergency. In case of Alpgain-initiated deletion for a user-attributable fault, no refund is due; in case of deletion without user fault, the pro-rata of the paid and unconsumed period will be refunded.
15. Changes to these terms
These ToS may be modified. Any material change will be notified to the user by email at least 30 days before it takes effect. Continued use of the service after that date constitutes acceptance of the new terms. Failing acceptance, the user may cancel their subscription free of charge before the effective date.
16. Governing law
These ToS are governed by Swiss law, to the exclusion of its conflict-of-laws rules and of the Vienna Convention on Contracts for the International Sale of Goods (CISG).
17. Forum and dispute resolution
Any dispute regarding the interpretation, performance or termination of these ToS shall fall under the exclusive jurisdiction of the courts of the La Côte judicial district (Morges, canton of Vaud, Switzerland), subject to mandatory consumer-protection provisions.
- Under Swiss law, a consumer residing in Switzerland may bring an action before the courts of their domicile (art. 32 para. 1 CPC).
- For users residing in the European Union, the jurisdiction rules of the Brussels I bis Regulation (no. 1215/2012) on consumer contracts may allow them to bring an action before the courts of their place of residence.
Prior to any judicial action, the parties shall endeavour to resolve their dispute amicably. The user may also contact contact@alpgain.ch for any amicable-resolution attempt.
18. Severability
If any provision of these ToS is held void, illegal or unenforceable, the remaining provisions shall remain in full force. The parties shall endeavour to replace the invalid clause by a valid provision producing an equivalent economic effect.
